Plan Change 2

Plan Change 2 to the Waimakariri River Regional Plan (PDF File, 2.38MB) proposes to remove from the Waimakariri River Regional Plan provisions that relate to the area covered by Section 8 (Waimakariri sub-region) of the Canterbury Land and Water Regional Plan (CLWRP). The WRRP continues to apply to the main stem of the Waimakariri River, the upper catchment including its headwaters, and an area of land south of the Waimakariri River.

Council has made Plan Change 2 to the Waimakariri River Regional Plan (WRRP) operative from 1 September 2023.

At a Council meeting held on 16 August 2023, we approved Plan Change 2 to the Waimakariri River Regional Plan, and in accordance with Clause 20 of Schedule 1 to the Resource Management Act 1991 resolved to make Plan Change 2 operative from 1 September 2023.

Plan Change 2

The Waimakariri River Regional Plan is the statutory framework for the management of rivers, lakes and hydraulically connected groundwater within the Waimakariri Catchment. Plan Change 2 reduces the area covered by the Waimakariri River Regional Plan.

Decision

At a meeting on 17 November 2021, Environment Canterbury made its decisions on submissions on proposed Plan Change 7 (PC7) to the Canterbury Land and Water Regional Plan and proposed Plan Change 2 (PC2) to the Waimakariri River Regional Plan.

The Council’s decisions was publicly notified on 20 November 2021 and the appeals period ran for 15 working days.

Proposed Plan Change 2 to the Waimakariri River Regional Plan was publicly notified under the Environment Canterbury Act 2016, so any appeals have been made to the High Court and are limited to questions of law.

Request for extension

The Minister for the Environment granted Environment Canterbury’s application for an extension to make its decision on Plan Change 7, until 9 December 2021.

The reasons for the Minister’s decisions are:

  1. Environment Canterbury has met the statutory requirements for making an application under clause 10A of Schedule 1 of the RMA
  2. Granting an extension would provide a clear statutory basis for Environment Canterbury to make its decision on PC2 and PC7 by 9 December 2021
  3. Environment Canterbury has the responsibility under the RMA to plan on PC7 and PC2, and it is reasonable for the regional council to seek to determine its view on whether the Overseer reports relate to those responsibilities before making a statutory decision
  4. While the delay will result in some additional, short-term uncertainty, providing additional time for Environment Canterbury to consider the implications of the Overseer report for PC7 and PC2 before proceeding to make a decision will provide greater clarity for all parties.
